General Terms and Conditions of Sale

These General Terms and Conditions of Sale (“T&Cs”) govern the sale of products offered on the website www.parisgolfgallery.com (“the Site”) by WRKS STUDIO SAS (“the Seller”).

ARTICLE 1 – PURPOSE
These terms define the rights and obligations of the parties in the context of the online sale of products offered by the Seller to the Client. They apply without restriction or reservation to all sales concluded via the Site.

ARTICLE 2 – PRODUCTS
The products offered for sale are those described on the Site, subject to availability. The Seller makes every effort to present the products as accurately as possible. However, errors or omissions may occur. Photographs and graphics illustrating the products are for illustrative purposes only and do not form part of the contract.

ARTICLE 3 – PRICES
Product prices are indicated in Euros (€), inclusive of all taxes (VAT included), excluding delivery fees. Delivery fees are indicated before the order is confirmed and are payable by the Client. The Seller reserves the right to modify prices at any time. Products will be invoiced based on the rates in effect at the time the order is validated by the Client.

ARTICLE 4 – ORDERS
Any order placed on the Site implies the Client’s full and unreserved acceptance of these T&Cs. To place an order, the Client must follow these steps:

  • Select products and add them to the cart.

  • Validate the cart.

  • Log in (create an account if not already done) or order as a guest.

  • Enter delivery and billing information.

  • Choose the delivery method.

  • Select the payment method and proceed with payment.

  • Confirm the order.

Order confirmation by the Client constitutes acceptance of our terms of sale and the price. The Seller undertakes to honor orders received within the limits of available stocks.

ARTICLE 5 – PAYMENT
Payment for orders must be made in full, by credit card (Visa, MasterCard, etc.), PayPal. The Site uses a secure online payment system, allowing the Client to encrypt the transmission of their banking data.

ARTICLE 6 – DELIVERY
Products are delivered to the address indicated by the Client at the time of order, within the timeframes specified when the order is validated. Delivery times are given for information only and may vary depending on the destination and chosen delivery method. In case of a delivery delay, the Client may instruct the Seller to deliver within a reasonable period. If the Seller does not comply within this period, the Client may terminate the contract.

ARTICLE 7 – RIGHT OF WITHDRAWAL (Applicable to consumers)
In accordance with articles L.221-18 et seq. of the French Consumer Code, the Client has a period of fourteen (14) calendar days from receipt of the products to exercise their right of withdrawal, without having to provide reasons or pay penalties, except for return shipping costs which remain the Client’s responsibility.

To exercise this right, the Client must notify the Seller of their decision to withdraw before the expiry of the period by any unambiguous statement (letter, email).

Products must be returned in their original condition, complete, unused, and in their original packaging. Personalized or perishable products are not eligible for the right of withdrawal.

Refunds will be processed within fourteen (14) days from receipt of the products by the Seller or proof of their shipment, at the Seller’s discretion.

ARTICLE 8 – LEGAL WARRANTIES
All products sold by the Seller benefit from the legal warranty of conformity (articles L.217-4 et seq. of the French Consumer Code) and the warranty against hidden defects (articles 1641 et seq. of the French Civil Code).

In the event of non-conformity of a product sold, it may be returned to the Seller who will proceed with its refund or replacement.

ARTICLE 9 – LIABILITY
The Seller cannot be held liable for any damage resulting from the use of the Internet such as data loss, intrusion, virus, service interruption, or other involuntary issues.

ARTICLE 10 – PERSONAL DATA PROTECTION
Personal data collected on the Site is processed in accordance with our Privacy Policy.

ARTICLE 11 – ARCHIVING AND PROOF
Computerized records kept in the Seller’s computer systems under reasonable security conditions will be considered as proof of communications, orders, and payments made between the parties.

ARTICLE 12 – DISPUTES AND APPLICABLE LAW
These T&Cs are subject to French law. In the event of a dispute, the parties will seek an amicable solution. Failing this, the dispute will be brought before the competent French courts.
